Пользовательское соглашение

Настоящий документ «Пользовательское соглашение» (далее — «Соглашение») представляет собой предложение компании Caravansary Limited, зарегистрированной в соответствии с законодательством Специального административного района Гонконг Китайской Народной Республики (регистрационный номер 3221152), являющейся правообладателем и оператором бренда Smena Station (далее — «Компания»), размещённое на сайте https://smenastation.com/ (далее — «Сайт»), использовать Сайт на условиях, изложенных в настоящем Соглашении.
Соглашение вступает в силу с момента выражения Пользователем согласия с его условиями в порядке, предусмотренном п. 1.3 Соглашения.
1. Общие положения
1.1. Пользователь настоящим подтверждает, что с момента посещения Сайта и в течение времени пользования Сайтом он является Пользователем вплоть до личного обращения к Компании с требованием об отказе от любых взаимоотношений с Сайтом, изменении или удалении данных о Пользователе.
1.2. Использование Сайта регулируется настоящим Соглашением, Политикой конфиденциальности, Офертой и иными документами, размещёнными на Сайте. Соглашение может быть изменено Компанией без специального уведомления. Новая редакция Соглашения вступает в силу с момента её размещения на Сайте.
1.3. Начиная использовать Сайт, Пользователь считается принявшим условия Соглашения в полном объёме, без оговорок и исключений. Если Пользователь не согласен с какими-либо положениями Соглашения, он не вправе использовать Сайт. Пользователь несёт персональную ответственность за проверку настоящего Соглашения на наличие изменений.
1.4. Начав использовать Сайт, Пользователь подтверждает, что он:
— ознакомился с условиями настоящего Соглашения в полном объёме до начала использования Сайта;
— принимает все условия Соглашения в полном объёме без изъятий и ограничений и обязуется их соблюдать либо прекратить использование Сайта.
Если Пользователь не согласен с условиями Соглашения, ему следует незамедлительно прекратить любое использование Сайта.
1.5. Проставляя отметку о согласии с Политикой конфиденциальности, Пользователь даёт своё согласие на обработку персональных данных на условиях Политики конфиденциальности.
1.6. Проставляя отметку о согласии с Политикой конфиденциальности, Пользователь подтверждает, что все её положения ему ясны и что он принимает их в полном объёме.
2. Основные понятия
2.1. Для целей настоящего Соглашения перечисленные ниже термины имеют следующее значение:
2.1.1. Smena Station — сервис, оказывающий услуги по бронированию места проживания и организации групповых программ, действующий под брендом Smena Station на доменном имени https://smenastation.com/.
2.1.2. Сайт — интернет-ресурс, содержащий информацию об Услугах, о Компании, позволяющий осуществить выбор, заказ и (или) приобретение Услуг.
2.1.3. Компания — Caravansary Limited, private company limited by shares, зарегистрированная в Специальном административном районе Гонконг Китайской Народной Республики под номером 3221152.
2.1.4. Пользователь — лицо, имеющее доступ к Сайту посредством сети Интернет и использующее Сайт.
2.1.5. Содержание Сайта — охраняемые результаты интеллектуальной деятельности, размещённые на Сайте.
3. Условия пользования Сайтом
3.1. Компания посредством Сайта размещает предложения о доступных услугах по бронированию временного проживания и участию в групповых программах, представленных в каталоге Сайта.
3.2. Пользователь получает доступ к средствам поиска и навигации Сайта, доступ к информации об Услугах, о приобретении Услуг, а также доступ к возможности консультации об Услугах.
3.3. Само по себе использование Сайта не требует предоставления персональных данных. Для того чтобы узнать больше об Услугах и оформить участие, Пользователь переходит по размещённым на Сайте ссылкам во внешние сервисы — Telegram-бот Компании и/или сервис бронирования встреч (Cal.com), — где и происходит дальнейшее взаимодействие, включая предоставление персональных данных, необходимых для оформления участия.
3.4. Персональные данные, предоставленные Пользователем в рамках взаимодействия через Telegram-бот, Cal.com и иные каналы связи с Компанией, обрабатываются Компанией в соответствии с условиями Политики конфиденциальности, размещённой по адресу https://smenastation.com/policy.
3.5. Компания вправе направлять Пользователям информационные сообщения через Сайт и/или его функционал; на адрес электронной почты; контактный телефон; в социальных сетях и мессенджерах, привязанных к нему. Информационные сообщения могут использоваться для консультаций по Услугам, для информирования и уточнения деталей, стоимости Услуги, согласования условий и т.д.
3.6. Направление Пользователю сообщений рекламного характера осуществляется исключительно при наличии соответствующего согласия Пользователя. Пользователь вправе отозвать такое согласие в любой момент, направив письменное обращение по адресу электронной почты smenastation@gmail.com с пометкой «Отказ от получения рекламных материалов».
3.7. В целях повышения качества Услуг Компания вправе осуществлять сбор мнений и отзывов Пользователей через Telegram-бот, по электронной почте или иные каналы связи, указанные Пользователем при взаимодействии с Компанией — в частности, после завершения участия в мероприятии. Собранные мнения и отзывы могут использоваться для формирования статистических данных и улучшения Услуг.
3.8. Сайт и Содержание, входящее в состав Сайта, принадлежат Компании. Содержание Сайта защищено применимым законодательством об авторском праве, товарных знаках и иных объектах интеллектуальной собственности.
3.9. Настоящее Соглашение распространяется на все дополнительные положения и условия предоставления Услуг, размещённые на Сайте. Компания имеет право в любое время без уведомления Пользователя вносить изменения в перечень Услуг, предлагаемых на Сайте, и в цены, применимые к таким Услугам.
4. Обязательства Пользователя
Пользователю запрещается:
4.1. Использовать любые устройства, программы, процедуры, алгоритмы и методы, автоматические устройства или эквивалентные ручные процессы для доступа, приобретения, копирования или отслеживания содержания Сайта.
4.2. Нарушать надлежащее функционирование Сайта.
4.3. Осуществлять несанкционированный доступ к функциям Сайта, а также к любым услугам, предлагаемым на Сайте.
4.4. Нарушать систему безопасности Сайта.
4.5. Использовать Сайт и его Содержание в любых целях, запрещённых применимым законодательством, а также подстрекать к любой незаконной деятельности или иной деятельности, нарушающей права Компании или третьих лиц.
5. Согласие на обработку персональных данных
5.1. Начиная использовать Сайт, Пользователь соглашается на обработку персональных данных на условиях Политики конфиденциальности.
5.2. Подробные условия обработки персональных данных приведены в Политике конфиденциальности по адресу: https://smenastation.com/policy. Пользователь самостоятельно несёт ответственность за то, чтобы ознакомиться с условиями обработки персональных данных.
5.3. Согласие действует до момента его отзыва. Согласие может быть отозвано в любой момент путём направления Компании уведомления посредством электронной почты на адрес smenastation@gmail.com с пометкой «Отзыв согласия на обработку персональных данных».
6. Использование cookies
6.1. Сайт использует файлы cookies и аналогичные технологии в целях аналитики и рекламы. Полный перечень используемых сервисов, а также порядок управления cookies приведены в Политике конфиденциальности по адресу: https://smenastation.com/policy.
7. Ответственность
7.1. Пользователь самостоятельно несёт ответственность перед третьими лицами за свои действия, связанные с использованием Сайта.
7.2. Сайт может содержать ссылки на другие ресурсы. Пользователь признаёт и соглашается с тем, что Компания не несёт ответственности за доступность этих ресурсов и за их содержание, а также за любые последствия, связанные с использованием их содержания.
7.3. Компания не гарантирует, что программное обеспечение Сайта не содержит ошибок или будет функционировать бесперебойно.
7.4. Компания не несёт ответственности за персональные данные Пользователя, которые Пользователь предоставляет сторонним ресурсам и/или иным третьим лицам при переходе на них с Сайта.
7.5. Ответственность за действия несовершеннолетних на Сайте лежит на их законных представителях.
8. Заключительные положения
8.1. Соглашение, приложения к Соглашению и изменения к ним вступают в силу с момента их опубликования по адресу: https://smenastation.com/terms.
8.2. К настоящему Соглашению и отношениям Сторон в связи с использованием Сайта применяется право Специального административного района Гонконг. Настоящий пункт не исключает применения императивных норм законодательства о защите прав потребителей страны обычного места пребывания Пользователя, если такое применение обязательно в силу применимых коллизионных норм.
8.3. Все споры, вытекающие из настоящего Соглашения или связанные с ним, подлежат разрешению путём переговоров. При недостижении соглашения споры подлежат рассмотрению в соответствии с процедурой, согласованной Сторонами, либо в компетентном суде Специального административного района Гонконг, за исключением случаев, когда императивные нормы применимого права предусматривают иную подсудность.

User Agreement

This User Agreement (the "Agreement") is an offer by Caravansary Limited, a company incorporated under the laws of the Hong Kong Special Administrative Region of the People’s Republic of China (company number 3221152), the rights holder and operator of the Smena Station brand (the "Company"), published on the website https://smenastation.com/ (the "Website"), to use the Website on the terms set out in this Agreement.
The Agreement takes effect from the moment the User expresses agreement with its terms in the manner set out in Section 1.3 of the Agreement.
1. General provisions
1.1. The User confirms that from the moment of visiting the Website and for as long as the User continues to use it, they are considered a "User" until they personally notify the Company of their wish to end any relationship with the Website, or to have their data changed or deleted.
1.2. Use of the Website is governed by this Agreement, the Privacy Policy, the Offer, and other documents published on the Website. The Company may amend the Agreement without special notice. A new version of the Agreement takes effect from the moment it is published on the Website.
1.3. By starting to use the Website, the User is deemed to have accepted the terms of the Agreement in full, without reservation or exception. If the User does not agree with any provisions of the Agreement, the User may not use the Website. The User is personally responsible for checking this Agreement for any changes.
1.4. By starting to use the Website, the User confirms that they:
— have read the terms of this Agreement in full before starting to use the Website;
— accept all the terms of the Agreement in full, without exclusions or limitations, and undertake to comply with them or to stop using the Website.
If the User does not agree with the terms of the Agreement, the User should immediately stop using the Website in any way.
1.5. By checking the box indicating agreement with the Privacy Policy, the User gives consent to the processing of personal data on the terms of the Privacy Policy.
1.6. By checking the box indicating agreement with the Privacy Policy, the User confirms that all of its provisions are clear to them and that they accept them in full.
2. Key definitions
2.1. For the purposes of this Agreement, the terms below have the following meaning:
2.1.1. Smena Station — a service providing accommodation booking and group program organization services, operating under the Smena Station brand at the domain name https://smenastation.com/.
2.1.2. Website — an online resource containing information about the Services and the Company, allowing the selection, order, and/or purchase of Services.
2.1.3. Company — Caravansary Limited, a private company limited by shares, incorporated in the Hong Kong Special Administrative Region of the People’s Republic of China under company number 3221152.
2.1.4. User — a person who has access to the Website via the Internet and uses the Website.
2.1.5. Website Content — protected results of intellectual activity published on the Website.
3. Terms of using the Website
3.1. Through the Website, the Company publishes offers of available accommodation booking services and participation in group programs listed in the Website’s catalog.
3.2. The User has access to the Website’s search and navigation tools, to information about the Services and about purchasing the Services, and to the option of receiving a consultation about the Services.
3.3. Using the Website by itself does not require providing any personal data. To learn more about the Services and register for participation, the User follows links published on the Website to external services — the Company’s Telegram bot and/or the meeting-booking service (Cal.com) — where further interaction takes place, including the provision of any personal data needed to register for participation.
3.4. Personal data provided by the User in the course of interacting via the Telegram bot, Cal.com, and other communication channels with the Company is processed by the Company in accordance with the Privacy Policy published at https://smenastation.com/policy.
3.5. The Company may send informational messages to Users through the Website and/or its functionality; to an email address; to a contact phone number; and via social media and messaging apps linked to it. Informational messages may be used for consultations about the Services, to inform and clarify details, pricing, and to agree on terms, etc.
3.6. Marketing messages are sent to the User only where the User has given the relevant consent. The User may withdraw such consent at any time by sending a written request to smenastation@gmail.com marked "Opt out of marketing materials".
3.7. In order to improve the quality of the Services, the Company may collect User opinions and feedback via the Telegram bot, by email, or through other communication channels provided by the User during their interaction with the Company — in particular, after participation in an event has ended. The feedback collected may be used to compile statistics and to improve the Services.
3.8. The Website and the Content forming part of the Website belong to the Company. The Website Content is protected under applicable copyright, trademark, and other intellectual property laws.
3.9. This Agreement extends to all additional provisions and terms for the provision of Services published on the Website. The Company has the right to change, at any time and without notifying the User, the list of Services offered on the Website and the prices applicable to such Services.
4. User obligations
The User is prohibited from:
4.1. Using any devices, software, procedures, algorithms and methods, automated tools, or equivalent manual processes to access, acquire, copy, or monitor the content of the Website.
4.2. Disrupting the proper functioning of the Website.
4.3. Gaining unauthorized access to the functions of the Website or to any services offered on the Website.
4.4. Breaching the Website’s security systems.
4.5. Using the Website and its Content for any purpose prohibited under applicable law, or inciting any unlawful activity or other activity that infringes the rights of the Company or third parties.
5. Consent to the processing of personal data
5.1. By starting to use the Website, the User agrees to the processing of personal data on the terms of the Privacy Policy.
5.2. Detailed terms of personal data processing are set out in the Privacy Policy at: https://smenastation.com/policy. The User is solely responsible for reviewing the terms of personal data processing.
5.3. Consent remains valid until withdrawn. Consent may be withdrawn at any time by sending the Company a notice by email to smenastation@gmail.com marked "Withdrawal of consent to personal data processing".
6. Use of cookies
6.1. The Website uses cookies and similar technologies for analytics and advertising purposes. A full list of the services used, as well as how to manage cookies, is set out in the Privacy Policy at: https://smenastation.com/policy.
7. Liability
7.1. The User is solely responsible to third parties for their own actions related to the use of the Website.
7.2. The Website may contain links to other resources. The User acknowledges and agrees that the Company is not responsible for the availability of such resources or their content, nor for any consequences arising from the use of their content.
7.3. The Company does not guarantee that the Website’s software is error-free or will operate without interruption.
7.4. The Company is not responsible for personal data that the User provides to third-party resources and/or other third parties when navigating to them from the Website.
7.5. Responsibility for the actions of minors on the Website rests with their legal representatives.
8. Final provisions
8.1. The Agreement, its appendices, and any amendments take effect from the moment they are published at: https://smenastation.com/terms.
8.2. This Agreement and the Parties’ relationship in connection with the use of the Website are governed by the law of the Hong Kong Special Administrative Region. This provision does not exclude the application of mandatory consumer protection provisions of the User’s habitual country of residence, where such application is required under applicable conflict-of-law rules.
8.3. Any disputes arising out of or in connection with this Agreement shall be resolved through negotiation. Failing agreement, disputes shall be resolved in accordance with a procedure agreed by the Parties, or before a competent court of the Hong Kong Special Administrative Region, except where mandatory provisions of applicable law require a different forum.
